SITE FINDING

1. Services Overview
Planco offers two subscription-based site-finding services: Basic Search and Comprehensive Search. Each service has distinct features, benefits, and fees as described below.
2. Subscription Plans and Fees
2.1 Basic Search
• Monthly Fee: $0 (free)
• Access to up to 10 site listings per month.
• Strategies limited to subdivision and multiple dwelling projects.
• Limited to sites within Sunshine Coast LGA.
• Site Finding Fee: 2% of the property value
2.2 Comprehensive Search
• Monthly Fee: $95 (billed monthly)
• Access to up to 10 site listings per month.
• Applicable to any development strategy.
• Access to any postcode and LGA within Queensland.
• Includes one free Development Potential Report (DPR) per month (valued at $495).
• Includes one 30-minute consultation per month.
• Site Finding Fee: 3% of the property value
• Cancel anytime.
3. Number of Listings
3.1 We strive to provide our subscribers with a target of at least 5 listings per month, with a maximum of up to 10 listings per month. However, Planco does not guarantee the availability of any specific number of listings in a given month. The number of listings presented will be determined by client search criteria, market trends, stock availability, and other external factors beyond our control.
3.2 In the event of limited stock, Planco will make every effort to present suitable alternative options to subscribers. There is no guarantee on the availability or timing of any specific listing at the time it is presented to subscribers. By subscribing, you acknowledge that listing availability is subject to change and may vary from month to month.
4. Site-Finding Fee
4.1 If a subscriber chooses to proceed with a development opportunity based on a property recommendation from Planco, a site-finding fee as a percentage of the property value is applicable. This fee applies to both the Basic Search and Comprehensive Search plans.
4.2 Commitment to Site-Finding Fee: By subscribing to the site-finding service, you agree and commit to pay the applicable site-finding fee if you decide to proceed with a purchase or development opportunity on any property identified through Planco’s recommendations.
4.3 Fee Calculation: The site-finding fee will be calculated as percentage of the agreed property purchase price or current market valuation, whichever is higher, and is due at the time the property transaction is completed.
4.4 Non-Refundable: The site-finding fee is non-refundable once the property transaction has been finalized, regardless of any subsequent changes in property plans, valuation, or development potential.
4.5 This fee is specific to properties identified through Planco’s listings, regardless of the subscription level. Subscribers agree to this site-finding fee as a condition of the service.
5. Feasibility Assessment
5.1 Please note that listings provided under both the Basic and Comprehensive Search subscriptions have not undergone detailed feasibility assessments. Planco provides these listings for informational purposes only and does not guarantee the viability of any particular site for development. The onus is on subscribers to conduct their own comprehensive feasibility studies and due diligence to determine if a property meets their investment or development criteria.
5.2 Subscribers should consult with qualified professionals to perform in-depth assessments on development feasibility, and other factors before proceeding with any property acquisition. Planco will not be held liable for any losses, costs, or damages arising from a subscriber’s reliance on a listed property’s development potential without a thorough independent assessment.
6. Subscription Payment Terms
6.1 Billing: Comprehensive Search subscribers will be billed monthly on a recurring basis. Payments are due at the start of each billing cycle.
6.2 Cancellation: You may cancel the Comprehensive Search subscription at any time by contacting us or using the account settings in your user profile. Cancellation will be effective at the end of the current billing period, and no partial refunds will be given.
7. Development Application (DA) Fee Discount
7.1 All subscribers to the Comprehensive Search plan are eligible for a 10% discount on DA fees if they engage Planco to handle the Development Application (DA) process. This discount is subject to the following conditions:
7.1.1 Unlimited Application: The 10% discount can be applied to any number of DAs managed by Planco during the active subscription period. The DA does not need to relate to a property listed in the site-finding listings provided through the subscription.
7.1.2 Exclusive Engagement with Planco: The discount applies only to Planco’s DA service fees and does not cover fees or costs from third-party consultants, agencies, or any other external providers engaged as part of the DA process. This includes, but is not limited to, additional consultants, surveyors, legal advisors, or government fees associated with the DA.
7.1.3 Service Scope: The discount is valid solely for standard DA processing fees handled by Planco. Any additional charges imposed by local councils, state agencies, or third parties are not covered under this discount and remain the responsibility of the subscriber.
7.1.4 Scope Changes: If there are significant changes in the project scope (e.g., a change in development type or scale) after the DA process has begun, which require a new DA application, the discount may not apply to the fees for the new application.
7.1.5 Eligibility Period: The DA Fee discount is available only while the subscription is active. If the subscription is cancelled or expires before the DA is finalized, Planco reserves the right to withdraw the discount and charge the standard DA fees.
7.1.6 Application of Discount: The 10% discount is applied to Planco’s DA service fees only and is calculated based on the standard rates applicable at the time of the agreement. This discount does not apply retroactively to any fees incurred before the subscription start date.
7.1.7 Non-Transferable: The DA Fee discount is specific to the subscriber’s project and is non-transferable to other individuals or projects.
7.1.8 Exclusions: The DA Fee discount cannot be combined with other promotions, offers, or discounts. Any other Planco service fees not directly related to the DA process, such as site assessments, feasibility studies, or consultation fees, are excluded from this discount.
8. Use of Services
8.1 Eligibility: Basic Search and Comprehensive Search are intended for individuals or businesses actively interested in property development. By subscribing, you confirm that you meet this criterion.
8.2 Account Usage: Planco reserves the right to limit, suspend, or terminate accounts if there is evidence of misuse or sharing of account access with non-subscribers.
9. Development Potential Reports (DPRs)
9.1 Comprehensive Search Subscribers are eligible for one free DPR per month, valued at $495. Unused DPRs do not roll over to the following month. Additional DPRs may be requested for an additional fee.
9.2 Limitations: DPRs provided are based on publicly available information and are advisory in nature. Planco is not liable for inaccuracies in DPRs resulting from incomplete or outdated public records.
10. Limitation of Liability
To the fullest extent permitted by law, Planco will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services, including, but not limited to, financial losses, loss of profits, or business interruptions.
11. Disclaimer
All information provided through the Services, including site listings, DPRs, and newsletter content, is for informational purposes only and does not constitute financial, legal, or real estate advice. Clients are advised to conduct their own due diligence before proceeding with any property acquisition or development.
12. Privacy and Data Collection
Planco collects personal information as necessary to provide the Services, as described in our Privacy Policy. By subscribing to any of our services, you consent to the collection and use of your information in accordance with our Privacy Policy.
13. Modifications to Services and Terms
Planco reserves the right to modify these Terms, the features of the Services, and pricing at any time. Notice of changes will be provided to current subscribers via email or on the Planco website. Continued use of the Services after any changes indicates acceptance of the new Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
