Before listing a Noosa property for short-stay letting, establish its lawful planning position and the applicable local-law requirements. An Airbnb listing, previous bookings or the seller’s assurance is not by itself confirmation of all required approvals.

Identify the accommodation model

Whole-home letting, occasional letting of a principal residence, home-hosted accommodation and a self-contained secondary dwelling can raise different questions. Describe who stays on site, what guests occupy, the number of rooms and occupants, and the proposed frequency of letting. Noosa and neighbouring Sunshine Coast are separate council areas; do not apply one council’s rules to the other.

Planning rights and local-law approval are separate checks

Check Evidence to investigate
Lawful planning position A development approval and conditions, the applicable accepted-development provisions or substantiated existing-use rights.
Local-law approval Whether approval is required, whether an exemption applies and what renewal or transfer steps are relevant.
Building suitability The lawful building status and appropriate classification, with advice from a building certifier.
Operating obligations Relevant management, contact-person, guest conduct and safety requirements.

Noosa requires lawful town-planning rights to be demonstrated before a short-stay local-law approval. Planning rights may arise in different ways, and the evidence must match the actual property and operation. Noosa Plan amendments that commenced in September 2025 further restricted additional short-term accommodation in specified zones. Check the current provisions rather than relying on an older guide or another property’s approval.

What if it has been holiday-let for years?

Investigate whether the use was established lawfully, when it commenced and whether its pattern and scale have changed. Relevant records can include decision notices, approved plans, dated booking histories, management agreements and written council advice. They need to be assessed together; recent bookings do not alone prove a lawful earlier use. Seek specific advice where existing-use rights are being claimed.

Check the conditions, not just the approval heading

Read any limits on bedrooms, occupants, areas used, parking, management and operation. Check local-law approval and renewal status and whether a transfer is needed when buying. Confirm the building classification and supporting safety documentation with the relevant professionals. Body-corporate rules and legal restrictions should be reviewed separately with your legal adviser.

Before buying a property advertised with short-stay rights

  • Obtain the complete planning approval, plans and all changes.
  • Identify the legal basis for the particular letting model you intend.
  • Obtain the local-law approval and check its current status and transfer requirements.
  • Confirm classification and any outstanding building or safety matters.
  • Have your solicitor address contract protections and request written clarification of unresolved matters before committing.
An appropriate first step

Send Planco the address, proposed letting arrangement and available approval records. A targeted review can identify what is established, what needs council confirmation and whether a planning application or change process should be investigated. Approval should not be assumed.
